Vivek Ramaswamy NOT a “natural born Citizen” of the United States to Constitutional Standards – NOT Constitutionally Eligible to Be President and Commander-in-Chief of Our Military – Missing 2 Legs re “nbC” Status

Vivek Ramaswamy NOT a “natural born Citizen” of USA to Constitutional Standards – NOT Eligible to be President and Commander-in-Chief of Our Military, or the Vice President, per U.S. Constitution | by:  CDR Charles F. Kerchner, Jr. (Retired) – 01 Jul 2023
Vivek Ramaswamy’s parents immigrated from India to the USA about the year 1983 per publicly available information and Vivek was born soon thereafter in 1985. It takes at least five (5) years to become a naturalized United States Citizen. Click on the image for more details about the Three Legged Stool Test.

Vivek Ramaswamy refuses as of the date of this article to answer direct questions regarding the citizenship and/or immigration status of his parents when he was born in 1985 in Ohio and/or exactly what year did his parents immigrate from India to the USA. And a third question that needs to be answered is if Vivek now holds dual citizenship or has he ever been held dual citizenship, i.e., in his case in both India and the United States.

After months of trying to get an answer from him via various contact modes, it is obvious he is deliberately evading answering such questions. Thus we must assume he does not want to answer those questions because he fears the true answers will be politically detrimental to his political aspirations. He wants to run for President and Commander in Chief but does not want to be fully transparent on this issue when transparency by candidates for the highest office in the land is of utmost importance to the electorate.

Based on the public information available at this time, and the fact that Vivek is evading answering direct questions on the matter, it has thus been deduced that both of Vivek Ramaswamy’s parents were not U.S. Citizens in 1985 when Vivek was born. When Vivek was born he acquired dual citizenship, one by place of birth and another via his parents. He was not born with singular citizenship and sole allegiance at/by birth to only the USA as is the case for a “natural born Citizen”. He was not born a “natural born Citizen” with the required three legs of being born in the USA to a father and a mother who were U.S. Citizens when Vivek was born. Vivek Ramaswamy fails “The Three Legged Stool Test” for being a “natural born Citizen” of the United States. Vivek Ramaswamy was born to a Citizen of India father (minus one stool leg) and to a Citizen of India mother (minus the 2nd stool leg).

The normal path to becoming a naturalized U.S. Citizen takes five years. Vivek Ramaswamy was born in 1985 . His father and mother emigrated from India to the USA about 40 years ago per the April 3rd, 2023 article in the Washington Post. Calculating back from 2023, that yields the immigration year to the USA for Vivek’s parents as being about 1983. Allowing +-2 years, i.e., 1981-1985 for that  calculated “about” year of 1983 for the deduced year of immigration to the USA, there was not sufficient time for either of Vivek’s parents to become naturalized U.S. Citizens when Vivek was born in 1985, since it required at least five years to become a naturalized U.S. Citizen.

It is not known at this time to this writer if Vivek’s father and mother ever became naturalized U.S. Citizens. Vivek Ramaswamy is not being very transparent on this issue. Even if one or both of his parents did naturalize later after Vivek Ramaswamy was born, it would not change Vivek’s birth status. Given Vivek Ramaswamy’s year of birth in 1985, and his parents immigration year of about 1983 to the USA, he was thus born in the USA to two foreign nationals and thus inherited their respective birth nation’s citizenship when he was born, in addition to being a basic Citizen by being born in the USA to aliens legally domiciled here. Thus Vivek Ramaswamy was born with citizenship and required national allegiance at birth to two countries. This is hardly what the founders and framers intended when they selected the “natural born Citizen” requirement for the person who would in the future be permitted to be the President and Commander in Chief of our military, once the founding generation was gone. The founders and framers wanted all future Presidents and Commanders in Chief to be free of foreign influence at/by birth and be born with unity of citizenship and sole allegiance at birth to only the USA. Having dual citizenship by/at birth such as Vivek Ramaswamy has makes one constitutionally ineligible to serve as President or VP.

As per ‘Principles of Natural Law‘ in place at the time of the founding of our country and when the founding documents including the U.S. Constitution were written, a ‘natural born Citizen’ is one born in the country to parents who are both Citizens (born Citizens or naturalized Citizens) of that country when their child is born in the country. See ‘The Three Legged Stool Test‘ for a graphic presentation of this constitutional requirement as to who can be President and Commander in Chief or our military. See the Euler Diagram shown further down for a logic diagram presentation of this constitutional requirement.

Vivek Ramaswamy is NOT a ‘natural born Citizen” of the United States to constitutional standards since both of his parents were foreign nationals and were NOT U.S. citizens when Vivek Ramaswamy was born in 1985 in the USA based on the available public information which indicates his parents immigrated to the USA about 1983. Vivek is missing two legs of the three legs of the ‘natural born Citizen’ test. He is of course a basic “Citizen” at birth per the Wong Kim Ark legal decision by the U.S. Supreme Court of 1898, and as such he is eligible to be a Governor or a Member of Congress, but he is not a “natural born Citizen” at birth, and thus is NOT eligible to be President and Commander in Chief of our military or the Vice President, per our U.S. Constitution. He inherited multiple national allegiances at birth due to his parents being foreign nationals living in the USA when he was born. Vivek Ramaswamy did not have sole allegiance and unity of citizenship at birth to the USA and only the USA.

Some other politicians besides Vivek Ramaswamy (R) in the two major political parties who have been mentioned for future election to high national political office, who are also not a “natural born Citizen” to constitutional standards are: Nikki Haley, Marco Rubio (R), Ted Cruz (R), Bobby Jindal (R), and Kamala Harris (D). Both major political parties are choosing to ignore the founders and framers intent and understanding of what a “natural born Citizen” is in order to run candidates that they believe are very marketable political candidates. This started in a major way in the 2008 election cycle with Obama vs McCain.

[Update added 22 Oct 2023: Vivek Ramaswamy admitted during live interview in Sep 2023 on NBC News that neither of his parents when he was born were citizens of the USA. Also, he admitted that although his mother later became a U.S. citizen his father never did. Watch the interview at about 26:08 into the interview: https://youtu.be/toiiWWFsWOw?si=EMOuYOGT93CmiKPn ]
