Mr. Kerchner: The DNC’s submission of letters to the various states ceriifying candidate Obama’s constitutional eligibility for the office of President is extremely troubling. DNC attorneys must be well aware of the legal risks they would ordinarily be taking, and the certainty that scores of individuals will be filing civil and criminal complaints against the DNC for these certifications. Moreover, the DNC knows that, because of the national importance of the eligibility question, one or several consolidated civil complaints might be heard and decided by the Supreme Court prior to the election. The foregoing strongly suggests that the DNC already has reason to believe that the Supreme Court will not issue a writ of certiorari prior to the election or that, alternatively, the Supreme Court will hear the case and find in favor of the DNC by a majority of five to four. The DNC has chosen to bring the Obama eligibility issue to a head, and I can find no other reason for their brazen confidence.
I would not be as alarmed if we had not already experienced Chief Justice Roberts’ contorted opinion in the Affordable Care Act case. To be blunt, after closely reading the text of Justice Roberts’ Opinion, as well as of the dissenting Opinions, and considering the curious circumstances surrounding the writing of Roberts’ Opinion (first in total opposition
to the Administration’s arguments, then, within three weeks of the deadline, finding a not credible and tortured way to up-hold the Act while simultaneously opening the door for the congress to use its taxing powers for any purpose whatsover) I conclude that the Roberts’ Opinion was driven by some extra-judicial issue. I believe that Chief Justice Roberts is too able a jurist to have authored an Opinion which is not credible and amateurish. I believe that Roberts is in no way venal nor particularly partisan. But I do believe that the Chief Justice, in some extra-judicial way, has been compromised.
I do not know the nature of Roberts’ vulnerability to extra-judicial forces, nor does it matter. But I do think that Roberts’vulnerability lies at the heart of the DNC’s decision to confidently bring the eligibility issue to a head. I have
little confidence that we Constitutionalists can expect relief in the civil courts. Nor do I believe that the criminal complaints which survive initial dismissal motions can be concluded prior to the election or survive post election appeals. We cannot look for help to the courts, nor to the Congress, nor to the entire spineless conservative commentariat, whether in print, radio, or TV. Only an Obama re-election defeat can save this country from irreparable harm.
